TARS Terms of Service

1. Acceptance

These Terms are an agreement between you and I12Y LTD, [registered address] ("we", "us"). By downloading or using TARS ("the app") you accept them. If you do not agree, do not use the app.

2. The service

TARS is an alarm clock that wakes you at your chosen time and can speak a short morning briefing composed from sources you enable (date, weather, your calendar and reminders). Parts of the service run on your device; optional briefing generation runs on our servers.

3. No account

The app requires no registration. You are responsible for the device settings the app depends on (alarm permissions, volume, Do Not Disturb configuration, keeping the app installed).

Do not reverse engineer, resell, or abuse the service (including automated or excessive briefing requests); do not use it to violate law or third-party rights.

6. Intellectual property

The app, its design, voices, and content are owned by us or our licensors. We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, as permitted by the App Store terms. Your calendar and reminder data remain yours; you grant us only the limited licence needed to generate your briefing.

7. AI-generated content

Briefings are generated by AI from the sources you enable. They may be incomplete, delayed, or wrong. Briefings are a convenience, not advice; do not rely on them as your only source for anything important.

8. THE ALARM DISCLAIMER — please read this one

We build TARS on Apple's AlarmKit specifically for reliability, and reliability is our first engineering priority. Nevertheless, no alarm — hardware or software — is guaranteed to fire in every circumstance (device powered off, dead battery, OS failures, deletion of the app, permissions revoked, device settings). TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY CONSEQUENCE OF A MISSED WAKE-UP, including missed flights, meetings, shifts, exams, or other losses. Do not rely on any single alarm, including TARS, where the consequences of oversleeping would be serious.

9. Third-party services

The app depends on services we do not control (Apple, RevenueCat, Supabase, Anthropic, OpenAI, Open-Meteo). We are not responsible for their availability or acts. Their terms apply to their services.

10. Privacy

Our Privacy Policy ([URL]) explains what little data we process and why. It forms part of these Terms.

11. Disclaimer of warranties

To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This does not exclude warranties that cannot be excluded under your local law.

12. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill; (b) our total liability for all claims relating to the app is limited to the amount you paid us in the 12 months before the claim. These limitations are a fundamental basis of the bargain. Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence (where such exclusion is not permitted, including the EEA and UK), or any consumer right that cannot lawfully be waived.

13. Indemnification

You will defend and hold us harmless from claims arising out of your breach of these Terms or your unlawful use of the app.

14. Termination

You can stop using the app at any time by deleting it. We may suspend or terminate the service (or these Terms) for breach or if we discontinue the app; active paid periods will be honoured or handled under Apple's refund rules.

15. Dispute resolution

Before any formal claim, contact us at support@tarsalarm.space — most issues are resolved fastest that way. Any claim must be brought within one year of the events giving rise to it, where permitted by law. To the extent permitted by applicable law, disputes will be resolved individually, and not as part of a class or representative action.

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions remain in full force.

18. Changes

We may update these Terms; the date above will change, and material changes will be noted in release notes. Continued use after a change means acceptance.

19. Governing law

These Terms are governed by the laws of [jurisdiction of I12Y LTD], without regard to conflict-of-law rules, and subject to any mandatory consumer protections of your country of residence.
